Possession of a Gun During a Drug Transaction Triggers Mandatory-Minimum Sentence, Whether it was Possessed Legally or Not

In Commonwealth v. Stein, the Defendant delivered drugs while possessing a gun which he had a carry permit for. The Superior Court found delivery of drugs while armed with a gun, whether legally or illegally, triggers the mandatory minimum sentence of five (5) in prison. As a result the Defendant is now serving that mandatory-minimum sentence.
